Borealis as Only Representative

Pursuant to REACH, substances as such, in mixtures and in some cases even in articles need to be (pre-)registered or authorised by the importer prior to being placed on the market in the European Union (EU).

A non-EU manufacturer cannot (pre-)register a substance by itself but may appoint an Only Representative (OR) established within the EU to fulfil the REACH obligations as an importer. By appointing an Only Representative, the non-EU manufacturer relieves the EU importer of his (pre-)registration obligations for substances covered by the OR. The EU importers are then regarded simply as downstream users within the stipulations of REACH.

Borealis AG has been appointed to act as an OR for certain substances manufactured by Borealis Compounds Inc., USA (Borealis Rockport) and Abu Dhabi Polymers Company Ltd. (Borouge). Imports of such substances by customers of Borealis Rockport and Borouge into the EU are only covered if specifically requested by the customer and accepted by Borealis Rockport or Borouge.

If you are a customer and you want to make use of Borealis’ OR services, please first contact Borealis Rockport or Borouge. Alternatively, you may send us a request at reach.or@borealisgroup.com . Only after your imports have been accepted by Borealis Rockport or Borouge and you have accepted the terms and conditions in the “OR acceptance letter” sent to you by the OR,  your imported volumes will be covered by Borealis AG’s (pre-)registration(s).
