Patent Attorney (f/m)

As a member of the IPR Team in Linz the role holder is responsible for:

  • pro-actively and on request providing assistance, advice and support in order to ensure and maximise the protection of intellectual property assets and rights of Borealis
  • handling activities of a qualified patent attorney
  • representing Borealis in patent courts in patent examination proceedings
  • providing freedom-to-operate (FTO) investigations and opinions.

 Key responsibilities

  • Handle activities of a qualified patent attorney in selected cases and assigned area of responsibility and assure resolution in best interest of Borealis:
    • Provide patentability opinions
    • Draft and file patent applications
    • Prosecute national/ regional and international patent applications
    • Support and contribute to the defence of proprietary patent rights in opposition and appeal proceedings, including oral proceedings
    • Represent Borealis in patent examination proceedings                                                                
  • Provide FTO investigations and opinions in assigned area of responsibility
  • Provide patent infringement and validity investigations and opinions in assigned area of responsibility
  • Ensure that third party patent rights are watched and analysed to secure FTO for Borealis
  • Support, contribute to or assume responsibility in assigned area in the handling of third party patent rights:
    • Secure monitoring of legal status of third party patent applications
    • Support and contribute to preparation of data and decision process for potential third party observations, opposition and appeal proceedings, SWAP deals and licensing in
    • Support and contribute to opposition and appeal proceedings against third party patent rights, including oral proceedings
  • Ensure that intellectual property protection opportunities, in particular relating to patents, utility models and trade secrets, are identified, analysed and protected
  • Contribute to legal agreement issues (non-disclosure / secrecy, joint development,  cooperation, license and IPR settlement agreements) relevant to assigned area of responsibility
  • Support and contribute in IPR enforcement and litigation actions relevant to assigned area of responsibility; focus being patent law and established case law of relevant jurisdictions, prosecution history of relevant patent rights, prior art and patent claim interpretation
  • Apply and share information to IPR group members and customers about patent laws and regulations and established case laws of relevant jurisdictions as a basis for efficient and high quality IPR delivery and work products
  • Support and contribute to creation and classification of Borealis patent portfolio overviews in assigned area of responsibility
  • Support and contribute to creation and classification of third party patent rights which are relevant to assigned area of responsibility and which are being/will be opposed by Borealis
  • Support and contribute to identification of potential gaps of the Borealis patent coverage in assigned area of responsibility
  • Update and keep complete the Borealis IPR registry system (DIAMS) and IPR matter management system (SharePoint)

Knowledge, Skills and Experience

  • Scientific technical degree; PhD, M.Sc., University, Dipl. Ing., Ing. or similar, preferably in chemistry and/or chemical or process engineering
  • Technology background in polymer chemistry and/or process technology desired
  • Qualified Patent Attorney of a major jurisdiction in the chemical field with at least 5 years of professional patent attorney experience in chemistry related industry and/or private practice
  • Knowledge of patent law and established case law of relevant jurisdictions, including the European Patent Convention and established case law of the Boards of Appeal of the European Patent Office
  • Strong expertise in several areas of IP (selected from searches, drafting and prosecution of patent applications, EP, US and CN patent practice, infringement opinions)
  • Business thinking and experience in order to drive protection of intellectual property assets and rights in the best interest of Borealis
  • Fluency in English, German Skills beneficial
  • Analytical, problem solution as well as coordination and organisational skills

In respect to Austrian Labour Law we have to state the minimum salary of positions. We offer a competitive compensation based on the collective labour agreement chemical industry starting at a minimum of EUR 57.350,- annual gross salary and are willing to pay considerably more based on experience and background of the candidate. In addition, we offer a yearly bonus and a Long Term Incentive Plan as well as a voluntary company pension plan.
